Former Jamie's Italian employees awarded eight weeks' pay by employment tribunal

Former Jamie’s Italian employees have been awarded eight weeks pay after an employment tribunal found the company had failed to carry out a full consultation prior to their redundancies.

 

Unite members turned to the tribunal after losing their jobs when the company fell into administration in May last year with the closure of all sites. A total of 76 employees who had worked across Edinburgh and Glasgow took part in the claim.

 

Bryan Simpson, Unite Organiser for hospitality, said: “We are delighted that the tribunal has ruled in favour of our members at Jamie’s Italian, who will now each receive eight weeks' wages in compensation.

 

“The judge held that Jamie’s Italian (in administration) failed to comply with Section 188 of the Trade Union Labour Relations (Consolidation) Act, which dictates how collective consultation must be carried out."

 

Unite has said the ruling should be a warning to other groups forced to look to redundancies as a result of the Covid-19 pandemic.

 

It added: “We will be ready and waiting to defend our members' interests to ensure they receive what they are entitled to.”
